These Terms of Use (“Terms”) govern your access to and use of the website located at www.ohi.net and any related pages, content, products, services, forms, and communications made available through the site (collectively, the “Site”) by Orthotic Holdings Incorporated, LLC (“OHI,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• use the Site in any way that violates applicable law or regulation;
• attempt to gain unauthorized access to the Site, servers, accounts, or networks;
• interfere with or disrupt the operation or security of the Site;
• copy, scrape, harvest, reproduce, distribute, or exploit Site content except as permitted by law or with our prior written consent;
• upload or transmit malicious code, spam, or harmful material; or
• use the Site in a manner that could disable, overburden, damage, or impair it.

The company’s privacy policy states that OHI does not knowingly collect personally identifiable information from children under 13.

5. SMS Communications

If you opt in to receive text messages from OHI through a web form or other method, you agree to receive SMS communications from OHI, which may include appointment scheduling, appointment reminders, post-visit instructions, lab notifications, and billing notifications, as described in the privacy policy you shared. Message frequency may vary. Message and data rates may apply. You may reply STOP to opt out and HELP for help. 

Consent to receive SMS messages is not a condition of purchase unless expressly stated. You are responsible for providing a valid mobile number and updating it as needed. OHI is not responsible for delayed or undelivered messages. Mobile opt-in data, SMS consent, and numbers collected for SMS purposes will be handled as described in the Privacy Policy. 

6. User Submissions

If you submit information through the Site, including contact forms, appointment requests, feedback, reviews, survey responses, or other communications, you agree that:

• the information you provide will be truthful, accurate, and not misleading;
• you will not submit unlawful, infringing, defamatory, obscene, or harmful content; and
• you grant OHI a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such submissions as needed to respond to you, provide services, operate the Site, comply with law, and enforce these Terms.

You remain responsible for the content you submit.

7. Accounts and Security

If any portion of the Site allows you to create an account, portal login, or password-protected access, you are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. You agree to notify us promptly of any unauthorized use or suspected security breach.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

OHI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. OHI DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OHI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OHI’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO OHI, IF ANY, FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless OHI and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or relating to your violation
